How Short-Term Rental Permits Work

Most hosts are surprised to learn that permits aren't optional — and that the penalties for skipping them can exceed $1,000 per day.

Determine Jurisdiction

Are you in city limits or unincorporated county territory? The rules are different — and so is which office you apply to. Many hosts apply to the wrong authority and lose weeks.

Apply for Your Permit

Gather documents: proof of ownership, proof of insurance, floor plan, and sometimes a site plan. Many counties now use online portals. Fees range from $50 to $500+ per year.

Pass Inspection (If Required)

In fire-prone counties like Placer County CA and Sevier County TN, a fire safety inspection is required before your permit is issued. Plan 2–6 weeks for scheduling.

Register for Lodging Taxes

Separately from your permit, most jurisdictions require you to collect and remit Transient Occupancy Tax (TOT), lodging tax, or sales tax on rental income. This is often handled through a different office.

Renew Annually

Most STR permits expire after 12 months. Listing on Airbnb or VRBO with an expired permit carries the same penalties as never having one. Set a reminder 60 days before expiration.

Many jurisdictions now require your permit number to appear in your listing. Airbnb and VRBO will ask for it. Some counties require the permit to be physically posted inside the rental.

It depends entirely on where your property is located. In most metro areas and popular vacation markets, yes — a permit, registration, or license is required before you can legally list. In some rural counties, no formal permit exists yet, but that's changing rapidly. The safest approach is to check with your county planning or zoning office before listing. Many jurisdictions require both separately. An STR permit (sometimes called a short-term rental license or vacation rental permit) authorizes you to operate the rental. A business license authorizes you to operate a business in that municipality. They're issued by different offices — the STR permit typically comes from Planning or Code Enforcement, while the business license comes from the City Clerk or Revenue office. Penalties vary by jurisdiction but are serious. Fines commonly range from $250 to $1,000 per day per violation. Some counties issue cumulative fines per booking rather than per day. In addition, Airbnb and VRBO now cooperate with local enforcement in many markets and may remove your listing or suspend your account. Yes — this is one of the most important distinctions in STR permitting. Properties inside city limits are regulated by the city. Properties in unincorporated county territory are regulated by the county. The rules, fees, and permit offices are completely different. Almost never. STR permits are typically issued to the individual owner, not attached to the property. When you sell, the permit dies with the sale. The new owner must apply fresh. In some jurisdictions with permit caps — like Clear Creek County, CO — this means the new owner may face a waitlist rather than immediate approval. Always disclose permit status in real estate transactions.
